Dallas replacement-property planning · October 13, 2026
Do not let the exchange clock replace due diligence.
Use tax and legal advisers to confirm eligibility and identification mechanics, while underwriting each Dallas replacement candidate on its own facts.

Quick answer
IRS Publication 544 says the like-kind nonrecognition rules apply only to real property held for investment or productive use in a trade or business, not property held primarily for sale. It also says replacement property must be identified within 45 days after the relinquished property is transferred.
That is a federal tax rule, not a recommendation to sell, exchange or buy a candidate. Have a qualified tax professional and attorney confirm the structure, dates, written identification and reporting before the relinquished sale closes.

1. Confirm the transaction before starting a property list
Confirm the taxpayer, ownership, use of the relinquished property, proposed structure and intermediary arrangements with qualified advisers. Publication 544 limits like-kind exchange treatment to qualifying real property held for investment or business use and says property held primarily for sale does not qualify under those rules. Do not use this page to decide whether a former residence, flip, partnership interest, related-party deal or proposed replacement qualifies. Preserve the adviser’s written assumptions and identify which facts still need documentation.
2. Record the adviser-confirmed clock
Publication 544 says replacement property must be identified within 45 days after the relinquished property transfer. It also describes the exchange period as ending no later than 180 days after that transfer or the due date, including extensions, for the tax return for the year of transfer—whichever is earlier.
Have the tax adviser confirm the transfer date, counting method and tax-return limitation. A calendar aid should copy those confirmed dates; it should not create them.
3. Make the written identification property-specific
The current Form 8824 instructions say replacement property in a deferred exchange is designated in writing in a document signed by the taxpayer or in a written agreement signed by all parties to the exchange. Ask the qualified intermediary and advisers who must receive the identification, what property description is sufficient and how revisions are handled. IRS Instructions for Form 8824
Keep the executed identification separate from working lists, broker searches and underwriting notes. This guide does not select a three-property, 200-percent or other identification method.
4. Underwrite each Dallas candidate independently
A candidate can fit an identification strategy and still fail as an investment. Use the Dallas rental analysis guide for property-specific rent, vacancy, expenses, financing and cash invested. Review rental property taxes, insurance terms and HOA rental constraints in separate lanes.
Do not assume a higher price, more debt, projected rent or a particular property type is required or sufficient for tax deferral. Ask the tax adviser to model recognized gain, basis and reporting using actual transaction numbers.
5. Preserve the reporting record
The IRS says Form 8824 is used to report each exchange of business or investment property for like-kind property. Keep the relinquished and replacement closing records, identification, intermediary documents, expenses, dates and tax-basis support available for the return preparer. IRS Form 8824 overview

Confirm the tax path, then keep underwriting honest.
Give advisers the transaction facts early and maintain separate records for identification, property due diligence, financing and tax reporting.
